万方数据 万方数据 摘要 摘 要 在当今中国社会，通过“公益诉讼”揭示违法行为已经成为推进中国法治 改革和进步的一种新模式。在食品安全领域，层出不穷的食品卫生隐患正不断 蝉食着行政机关及法律文件的公信力，也在一定时间和空间范围内造成了公众 的不安与恐慌。当然，加强食品卫生行政监管及预防措施固然十分重要，然而 面对大规模的“轻微”食品安全隐患或者具有“隐性”毒害后果的食品安全事 故等等侵权行为时，对社会公众基本的生命权和健康权的救济和保护便显得更 为急切和必要；再加上“食品”这一特殊的消耗品具有相对隐蔽和潜在的影响 力，也同时具有一定的空间广泛性和时空延续性，我们可以从“食品安全”领 域出发，并结合其他相关领域公益诉讼制度，着手深入研究该领域内公益诉讼 制度的构建，以期更好得维护社会公益，填补法律漏洞。本文通过对“食品安 全社会公益”及“公益诉讼”等概念的深入理解和剖析，在对比借鉴其他法域 相关制度和理论的基础上，在保护社会公益原则、全面问责原则和公权力协调 参与原则的法理支撑上，从维护司法公正、保护弱势群体、保障人权等方面对 构建食品安全公益诉讼的可行性和必要性进行分析和讨论，以期对食品安全领 域公益诉讼程序法律规范的理论发展提供一定的参考作用。 关键词：食品安全；公共利益；食品安全公益诉讼 II Abstract ABSTRACT In todays Chinese society , through the public interest litigation reveals violations have become a new model to promote Chinese law reform and progress. The purpose of public interest litigation is not confined to ordinary private interest relief, but has incentive to promote the whole society and the state authorities to resist unlawful , unreasonable behavior against the public interest , it is more valuable and noble lies , this bottom-up movement supporting a rational legal and benevolent rule of law, which is a based on the existing legal and social patterns of the upper , and strive to proceedings through a rigorous and rich order to realize China litigation model to improve the rule of law and social progress. In the area of food safety , food hygiene risks emerging cicadas are constantly eating the credibility of the executive authorities and the relevant normative legal documents , but also within a certain range of time and space, causing public anxiety and panic.
