II II Abstract Commutation system is an important mechanism of the enforcement of punishment as well as a measure to realize the penalty purpose, which plays a key role in the transformation of the criminal. During the development of criminal justice science, the regulation of commutation of probationers, as a new field of commutation system, being concerned by theoretical circles and practitioners. Though probationers have its own particularity, it should be commutate equally as the other criminals. Work well the commutation of probationers, not only can improve the level of law enforcement by polices, and has an important real significance for arousing the criminals reforming enthusiasm to return to the society and their family earlier. The stipulation of the commutation of probationers in the judicial interpretations of our country experienced a process which from harsh to easy. But it must be provided definitely in legislation and judicature, the commutation of probationers can form a scientific mechanism. The regulation of commutation of probationers analyse and expound the concept, origination and development sense, requirement, in order to find out the problems and insufficiencies, and put forward measures to reform and perfect it. And enforce the operability of commutation of probationers in judicial practices, and serve the penalty purpose better. Commutation of probationers in our country appears a lot of aspects which are not conducive to achieve the purpose of penalty, because of criminal law and policies about commutation of probationers of our country in modern time are short of scientific composition.
