摘要 摘要 万方数据 万方数据 摘 要 随着中国特色法律体系的完善，立法的质量变得日益重要。立法质量密切地 联系着人们社会生活，同时也为社会发展提供支持。立法并非越多越好，而是应 与社会发展的客观要求相适应，当无法可依的问题解决之后，立法的数量积累到 一定程度的时候，就应该把提高立法质量确定为立法的重中之重，而立法后评估 制度就是提高立法质量的有效方式和途径。它既体现了科学立法的基本要求，同 时又提高了立法过程中的公众参与程度，是近年来各级地方人民代表大会及常委 会所普遍采取的一项制度。所谓地方立法后评估制度是指由具有立法权的国家机 关在地方性法规或政府规章实施一段时间后，委托评估实施主体按照法定的评估 程序，对法律的合法性、合理性、协调性、技术性等指标进行评估并提出维持、 修改或者废止等建议的制度。虽然地方立法后评估制度能够切实提高立法质量， 增进立法过程中的公众参与，但是我国目前的立法后评估制度在实践操作中存在 着众多的问题，亟需形成相对价值统一的制度规范。 关键词：立法后评估；制度化；完善 II AB ABSTRACT ABSTRACT With the improvement of the legal system with Chinese characteristics , the quality of legislation has become increasingly important. The quality of legislation closely linked with peoples social life , while also providing support for social development .
