法律文件的翻译 例1： The parties hereto shall, first of all, settle any dispute arising from or in connection with the contract by friendly negotiations. Should such negotiations fail, such dispute may be referred to the People’s Court having jurisdiction on such dispute for settlement in the absence of any arbitration clause in the disputed contract or in default of agreement reached after such dispute occurs. 解析：双方首先应通过友好协商，解决因合同而发生的或与合同有关的争议。如果协商未果，合同中无仲裁条款约定或争议发生后未就仲裁达成协议的，可将争议提交有管辖权的人民法院解决。 解析：本句中的shall和may表达准确。出现争议后应当先行协商，所以使用shall表示义务性约定；如果无法协商解决，作为当事人的权利，使用may表示选择性约定，也很妥当。如果may和shall调换位置会怎么样？前半句的shall换用may后，意思变成了当事人可以通过协凋解决，缺乏法律文件的严谨性。但后半句的may换用shall后，变成了应当诉公解决，好象一出事，就要打官司，这就有些不友好了。再者，副词hereto也无实际意义。 法律文件的翻译 例2：If the insured property enumerated in the Schedule is more than one item, the provision of this clauses shall apply to each thereof. 译文：如本保险所载项目不止一项时，赔款按本规定逐项计算。 解析：使用了法律常用古语thereof，但并无实际意义。 例3：本合同自买方和建造方签署之日生效。 译文：This Contract shall come into force from the date of execution hereof by the Buyer and the Builder. 解析：使用了hereof，并无实际意义。 文学的翻译 例 1: 沿着荷塘，是一条曲折的小煤屑路。这是一条幽僻的路；白天也少人走，夜晚更加寂寞。荷塘四面，长着许多树，蓊蓊郁郁的。路的一旁，是些杨柳，和一些不知道名字的树。没有月亮的晚上，这路上阴森森的，有些怕人。今晚却很好，虽然月光也还是淡淡的。 曲曲折折的荷塘上面，弥望的是田田的叶子。叶子出水很高，像亭亭的舞女的裙。层层的叶子中间，零星地点缀着些白花，有袅娜地开着的，有羞涩地打着朵儿的；正如一粒粒的明珠，又如碧天里的星星。微风过处，送来缕缕清香，仿佛远处高楼上渺茫的歌声似的。这时候叶子与花也有一丝的颤动，像闪电般，霎时传过荷塘的那边去了。 文学的翻译 译文： A path paved with coaldust zigzags along the lotus pond, so secluded as to be little frequented in the daytime, to say nothing of its loneliness at night.
