Unit 10 Complaints and Arbitration Text B IPad Trademark Troubles in China 1  The iPad is, of course, made in China. But lately, Apple has had trouble selling it there. 2  In the most recent development, the Shenzhen subsidiary of the Hong Kong-based company has filed an injunction to restrict Apple from selling iPads in China altogether, according to People’s Daily Online. 3  LED maker Proview International’s Taiwan subsidiary, Proview Electronics, registered the iPad trademark in Europe and other parts of the world in 2000. In 2001, Proview Technology (Shenzhen) registered the trademark for iPad PCs on the Chinese mainland. The U.S. computer maker, Apple, bought the trademark from Proview Electronics for US$54,687 in 2006, but it did not obtain the Shenzhen branch’s trademark rights. 4  In 2011, Proview Shenzhen took legal action against Gome’s Shenzhen branch, one of Apple’s retailers in China, seeking 240 million yuan (US$38 million) in damages. Apple later countersued, but the case was dismissed. Unit 10 Complaints and Arbitration Text B 5  While Apple had acquired the rights to the name in Taiwan, the rights in the contract did not extend to its use on the Chinese mainland, according to a court ruling in 2011 favoring Proview Technology. 6  Proview Technology’s lawyer, Xie Xianghui, confirmed that the Chinese subsidiary filed an order with Beijing’s court, seeking for Apple to temporarily discontinue the selling and marketing of the iPad in China, and issue an apology. 7  Proview has also filed a complaint in two other Chinese cities and sued two other retailers selling iPads. 8  While lawsuits in the United States typically entail years of litigations, verdicts in China are more often concluded in a matter of several months.
