从主体的角度理解国际法 摘要 ; 个人的国际法主体地位实际上是个人与国家间关系的演进在国际法上的忠实反映，而近代国际法特定语境中的”国家”正是起源于16世纪的欧洲，并在20世纪成为人类普适性形式的”民族国家”。自18世纪以来才被称为”国际法”的这个体系经历了从”万民法”到”国际法”的过程，并有可能在未来演变成为新的万民法--人类共同法。 关键词： 国际法 主体 个人民族国家; 万民法; 人类共同法;Abstract ; position of individuals in international law is , in fact, the reflection of the relation between the individuals and state. The “state” in the international law context is nothing else but the “Nation-State” originated from Europe in sixteenth century, and proved itself as the overwhelming political structure in twentieth century. The legal system , which entitled as “internati
