摘要 随着我国社会主义市场经济的发展，人们的物质生活水平有了很大的提高。相伴而来的是人们对财产所有权的明确要求，无论是针对普通的合同当事人还是对相伴到老的夫、妻。这就关涉到夫妻财产制的立法状况。我国对《婚姻法》进行了三次修正，2001年最新的《婚姻法》确立了法定财产制和约定财产制，并增设了个人特定财产制作为法定财产制的补充。固然这一规定适应了我们现阶段的社会发展现状，但我们还必须看到其还存在着亟需完善的地方。本文首先对我国夫妻财产制度的立法沿革作了简要介绍；第二部分从现行夫妻财产制度与以往财产制度的对比出发，肯定了我国现行夫妻财产制度的进步意义；然后基于三个原因指出了当代夫妻财产制度发展的趋势，最后试着针对我国现行的夫妻财产制度的不足和如何完善提出了一些自己的观点和建议。 关键词 夫妻财产制度，法定财产制度，约定财产制度， Abstract Along with the development of our countrys socialist market economy, the level of peoples material life had enhanced very much. Accompanied problem is people s right of the property , whether for ordinary parties related with the contract or for you husband or wife accompanied with you .This relates to the condition of husbands and wives property system legislation. Our country has carried on three revisions to Marriage law. In 2001, the newest Marriage law has established the legal property system and the agreement property system, and additionally has built the individual specific property manufacture for the legal property system supplement. No doubt that this stipulation has adapted the development of our present situation , but we also must see it also has the place which urgently needs consummation. Firstly ,this article has made the brief introduction to the evolution of our countrys husbands and wives property systems legislation .Based on the contrast of the present husbands and wives property system and the former property system , the second part has definited our country present husbands and wives property systems progressive significance. Then it has pointed out three reasons of the contemporary husbands and wives property system development tendency. Finally, it trys to address the deficiencies of our countrys current marital property system and give some views and recommendations to this.
