摘 要 近年来,随着购物方式的多样化以及互联网技术的发展,网络购物因其独特 的便利性在众多购物方式中脱颖而出,随之而来的新型支付工具也得以快速发展, 以第三方支付为代表的支付方式应运而生。 然而,我国目前第三方支付消费者权益保障存在诸多问题,如消费者个人信 息保障制度不完善、消费者资金安全保障制度不完善、消费者知情权保障制度不 完善等问题,加之消费者纠纷解决机制不完善,消费者在第三方支付业务中始终 处于相当弱势的地位其合法权益极易受到来自第三方支付机构本身的侵害。因, 此,我国应当从法律上对第三方支付机构进行更深层次的规范,建构起与之相称 的消费者权益保护机制,以确保第三方支付产业在我国持续健康地发展。世界其 他国家和地区如美国、欧盟均对第三方支付消费者权益保障进行了相关规定,我 国可以吸取其经验教训。要保障我国第三方支付持续稳健发展,不仅要保护消费 者的个人信息和资金安全,还要保障消费者的知情权,披露与消费者密切相关的 重要信息,并且要完善消费者纠纷解决机制,让法律法规落到实处,切实保障第 三方支付消费者权益,如此多管齐下才能推动第三方支付的长足发展。 关键词:第三方支付;非金融机构;资金安全;法律监管;消费者维权 I Abstract In recent years, with the diversification of shopping methods and the development of Internet technology, online shopping stands out in many shopping methodsbecause of itsunique convenience, and the following new payment tools are also developing rapidly, and the payment method represented by the third-party payment isborn. However, at present, there are many problems in the protection of the rights and interests of the third-party payment consumers in China, such as the imperfection of the consumer personal information protection system, the imperfection of the consumer fund security system, the imperfection of the consumer right to know protection system, and the imperfection of the consumer dispute resolution mechanism,the consumer has alwaysbeen in arather weak position in thethird-party payment business, Its legal rights and interests are easily infringed by the third-party payment institutions themselves. Therefore, we should regulate the third-party payment institutions in a deeper level in law, and build a corresponding consumer protection mechanism to ensure the sustainable and healthy development of the third-party payment industry in China.
