经典专科、本科、硕博、研究生、期刊毕业论文 仅供参考 精心整理 仅供参考 勿用作商业用途 论强奸案件证据收集和认定 【摘要】我国刑事诉讼证明标准是案件事实清楚且证据充分和准确。证据充分说明案件都要用证据来证明并且是合理合法地收集和经法定程序查证。据《刑法》第236条规定强奸罪，目前理论界通行的认识是认为本罪的本质特征在于违背妇女的意愿，而强制与其发生性行为，采用手段是暴力胁迫或者其他较为残忍的手段，而这些手段都具有是被害妇女不知反抗甚至是不能反抗。强奸案件的犯罪特点是具有隐蔽性；由于它的特点决定了此类案件在司法实践中收集证据比较困难并且证据单一这一特性，它的书证少、直接证据少但是间接证据又会多的这样一种形态。强奸罪中的对于证据采信以及证明力的问题，决定了整个案件的命运，如果不结合案件本身的语境状态来分析，会导致真相的埋没和公正的沦丧，所以强化对强奸案件的证据意识、提高分析运用证据的能力、重视对言词证据、间接证据的收集、加强证据审核综合审查判断是对准确断案起着决定性作用。 【关键词】证据类型、证明方法、证据认定、特殊问题 【Abstract】Criminal procedure law of our country prove standard is clear the case facts and evidence fully and correctly.Evidence that the case has proved reasonable and verification through legal procedure.According to the stipulations of article 236 of the criminal law of rape,the current theorectical circle passage and to know is that is the essence of this crime against women will,forced to have sex,by means of violence intimideati or other more cruel means，and they have is murdered women don’t know against even can’t resist.A rape is characterized by concealment crime; Because it determines the characteristics of such cases in the judicial practice,be difficult to collect evidence and evidence of a single this feature,it’s less documentary evidence,direct evidence but less indirect evidence is more a kind of state.Rape in answer to the question of the admissibility of evidence and probative value decides the fate of the whole case,if not combined with the case to analyze the context of the state,can lead to bury the truth and fairness of bankruptcy,so strengthening evidence consciousness of rape cases,improve the ability of using the evidence,the emphasis on oral evidence,indirect evidence collection,strengthening the comprehensive review of audit evidence is judgment plays a decisive role for accurate solving criminal cases. 【keyword】Types of evidence,Way the prove,Evidence that,Special problem 在法律事务中，强奸案件证据收集和认定比普通的刑事案件的证据收集和认定更加困难，是因为强奸案件拥有隐蔽性这一特征。虽然强奸案件里可以用现场的录音录像、被害人的体表伤情等客观证据作为直接证据，但是这些证据有
