经典专科、本科、硕博、研究生、期刊毕业论文 仅供参考 精心整理 仅供参考 勿用作商业用途 中文摘要 我国经济的飞速发展的同时犯罪率也在不断攀升，在案件数量不断增加的同时，司法资源却未能同步增加，案件数量的堆积使得司法压力不断增大。优化司法资源配置，简化刑事诉讼程序已经成为迫在眉睫的工作。纵观其他国家，大都通过构建刑事快速审判程序来缓解诉讼压力。我国从2014年开始开展刑事速裁程序试点工作，目的在于结合我国国情构建适合我国实际司法需要的速裁程序。在试点过程中，刑事速裁程序显示了其在提高诉讼效率方面的效果，但是也显现出其存在的诸多问题。目前为期两年的试点工作已经结束，《认罪认罚从宽试点办法》的出台肯定了刑事速裁程序试点，并在《刑事速裁办法》的基础上对速裁程序进行了细化，进一步探究如何优化我国司法资源配置。 本文从介绍刑事快速审判程序的内涵与价值开始，继而对我国刑事速裁程序试点工作进行总结，并分析了刑事速裁试点工作中显现的问题；然后通过对大陆法系和英美法系代表国家的刑事快速审判程序进行分析，归纳其特点，借鉴其可适用于我国刑事速裁程序之处；最后在结合我国实际情况和借鉴域外经验的基础上，对如何构建我国刑事速裁程序提出建议。 关键词：刑事速裁，轻微刑事案件，效率，公正，人权保障 精心整理 仅供参考 勿用作商业用途 ABSTRACT In our country,the economy develops rapidly but at the same time the crime rate is rising, since the judicial resources failed to increase, the accumulation of the number of the case makes the judicial pressure increasing.It is urgent to optimize the allocation of judicial resources and simplify criminal procedure.In other countries, the pressure of litigation is alleviated through the construction of the criminal quick trial procedure.Our country also began to carry out the pilot work of fast-track sentencing process in 2014, the purpose is to construct the criminal quick trial procedure that is suitable for our country which suits actual judicial needs.In the pilot process, the criminal speed procedure shows its effectiveness in improving the efficiency of litigation, but it also shows its problems.The two-year pilot work has ended, the issue of plea for leniency affirmed the pilot fast-track sentencing process.The provisions of the fast-track sentencing process are refined.The plea for leniency further explores how to optimize allocation of judicial resources in our country.
