Health Management Teaching and Research Section Lili 突发公共卫生事件应急法律制度 System of Law on Preparedness for and Response to Emergent Public Health Hazards 一、概述（Outline） to prevent effectively, control timely and eliminate the damage of the public health emergencies 有效预防，及时控制和消除突发公共 卫生事件的危害 to safeguard the public health and life security to maintain the normal social order 保障公众身体健康与生命安全，维护正常的社会秩序 The 7th standing committee conference of the State Council adopted it on May 7th 2003年5月7日国务院第7次常务会议通过 Regulation on Preparedness for and Response to Emergent Public Health Hazards 《突发公共卫生事件应急条例》 Promulgate and implement on May 9th 5月9日公布与实施 （一）立法背景 （Background of Legislation） International National SARS epidemics Case one Anthrax in USA 上海甲肝暴发：自1988年1月19日起，上海市民中突然发生不明原因的发热、呕吐、厌食、乏力和黄疸等症状的病例，数日内成倍增长，截至到当年的3月18日，共发生29230例。 山西朔州毒酒事件：1998年春节前，山西文水县一不法分子用甲醇勾兑散装白酒流向社会后，被山西朔州市、大同市部分群众饮用，从1月26日起开始有人中毒。患者呕吐、头痛、呼吸困难，没等救治便相继死亡。短短几天时间，朔州、大同等地先后发现数百名群众饮用假酒中毒住院，其中近30人死亡。 南京汤山中毒事件：2002年9月14日，南京汤山发生一起特大投毒案。犯罪分子陈正平潜入“正式”面食店，将所携带的剧毒鼠药“毒鼠强”投放到该店食品原料内，造成395人因食用有毒食品而中毒，死亡42人。 河北白沟苯中毒事件：2002年初，在河北省高碑店市白沟镇箱包生产加工企业打工的几名外地务工者，陆续出现了中毒症状，并有6人相继死亡，后经卫生部门调查确定为苯中毒事件。 （一）立法背景 （Background of Legislation） the deficiency of the emergency rapid response mechanism inaccurate information slow response insufficient preparation etc. （二）概念** （definition） Emergent Public Health Hazards It is the cases which appear suddenly ,have or will grievously damage the public health ,include the serious epidemics, widespread unidentified diseases, food and industrial poisoning and other serious cases detrimental to public health. 突发公共卫生事件 是指突然发生，造成或者可能造成社会公众健康严重损害的重大传染病疫情、群体性不明原因疾病、重大食物中毒和职业中毒以及其他严重影响公众健康的事件。 突发公共卫生事件的特征 1、appear suddenly and can not be prognosticated 突然发生，不可预测 2、the public health property 有公共卫生属性 3、damage and influence in some
