主讲教师：王楠 《外贸单证实务》课程 信用证修改 信用证修改 一、信用证修改的原因 　　当出口商根据合同对信用证进行审核后，若发现与合同规定的内容不符或不能接受或无法办到的条款，为不影响合同的履行和收汇的安全，可按合同规定向进口商提出修改信用证。进口商因一些形势或情况的变化，也可以按规定对信用证提出修改。 二、必须修改的条款 1、信用证涉及侮辱性条款 2、信用证存在政策性问题 3、信用证漏写有效期 4、信用证货物描述部分与合同不符 5、信用证的总金额、计价货币、金额大小写与合同不符 信用证修改 6、信用证存在矛盾性条款。 7、信用证的软条款必须要求删除。 8、信用证中的交单期或有效期距装运期太近。 9、信用证指定卸货泊位或指定卸货码头。 10、信用证规定商业发票由开证人会签的条款。 信用证修改 三、信用证修改时应注意的问题： 1、对于审证过程中提出的问题，如必须修改的内容，出口人应告知开证申请人提请开证行进行修改。 2、一份信用证中有几处修改的内容，应几种在一起一次通过开证行办理修改手续，通知开证申请人。 3、按有关规定对统一修改通知书中的修改内容不允许部分接受。 4、修改通知书再经原通知行传递方为有效。 信用证修改 四、拟写改证函 　　一份规范的改证函主要包括三方面内容： 　　1.感谢对方开来信用证。 　　2.列明不符点并说明如何修改。 3.感谢对方合作，并希望信用证修改书早日开到。 信用证修改 格式： 第一个主题: 感谢来证。如下: Thank you for your L/C No. xxxxx issued by xxxxx dated xxxxx. We are pleased to receive L/C No. xxxxx established by xxxxx dated xxxxx against S/C No. xxxxx. 信用证修改 第二个主题: 列明不符点。例如： However, we are sorry to find it contains the following discrepancies: But the following points are in discrepancy with the stipulations of our S/C No. xxx: Please add the word … before … Please delete the clause ... and insert the wording ... Pleased amend the ... to ... The amount should be … not / instead of ... Please extend the shipment date and the validity of the L/C to ... and ... respectively. 信用证修改 第三个主题:催促改证。如下： Thank you for your kind cooperation. Please see to it that the L/C amendment reach us before xxxx (date), falling which we shall not be able to effect punctual shipment. 信用证修改 信用证修改 结束
