PAGE 18 毕业论文 学院 年 级 20 级 专 业 学生姓名 学 号 指导教师 完成日期 202 年 月 人民调解员责任制度转型的研究 摘要：人民调解制度作为一种特殊的纠纷解决方式，因其在调节纠纷与利益冲突上更为高效灵活而广为人们接受。但现如今我国的人民调解制度处于不断探索的阶段，仍未全面完善的调解制度无法与大量的调解需求相协调，调解过程中由此而产生的问题也一定程度上阻碍了调解制度的发展。而人民调解员作为调解工作开展的核心力量，对调解员行为的原则性规范和约束，归根结底还是与当事人的合法权益密不可分，最终目的都是为了在调解过程中更好地保障当事人合法权益，而最有效、最根本的方法则是要求调解员对其不法行为承担一定的不利后果以达到预防、惩罚的目的，相应责任制度进行更为合理的转型亦有利于人民调解制度的完善。故本文在对人民调解员责任制度转型的必要性、借鉴相关责任制度的经验等方面进行讨论的基础上，进行了对相对合理的人民调解员责任制度的探索，为人民调解员责任制度的构建提供相关的建议。 关键词：人民调解员 责任制度的转型 基本方向及设想 ABSTRACT:As a special way of dispute resolution, peoples mediation system is widely accepted because it is more efficient and flexible in mediating disputes and conflicts of interest. But now our countrys peoples mediation system is in the stage of continuous exploration, the mediation system which is not yet comprehensive and perfect can not coordinate with a large number of mediation needs, and the problems arising from the mediation process also hinder the development of the mediation system to a certain extent. The peoples mediators, as the core force of mediation, are inseparable from the legitimate rights and interests of the parties in the final analysis. The ultimate goal is to better protect the legitimate rights and interests of the parties in the process of mediation, and the most effective and fundamental method is to require mediators to bear certain adverse consequences for their illegal acts In order to achieve the purpose of prevention and punishment, a more reasonable transformation of the corresponding responsibility system is also conducive to the improvement of the peoples mediation system. Therefore, based on the discussion of the necessity of the transformation of the peoples mediator responsibility system and the experience of the relevant responsibility system, this paper explores the relatively reasonable peoples mediator responsibility system
