中文摘要 健康权是一项基本人权，受到法律的确认、保护和救济。民法、刑法等法律 的保护是消极保护，即事后救济，不能真正实现健康权保障。而卫牛法的保护是 积极保护，即事前救济，能够真正实现健康权的保护。 近年来，诸多损害人们健康权的公共卫生事件时有发生，基于此，本研究在 借鉴国内外相关研究的基础上，从卫生法的角度对保障健康权进行研究。其目的 是阐述制定卫牛基本法的必要性和可行性，以及完善相关卫牛法律制度，结合我 国国情提出自己的建议与对策，为建立健全、统一的卫生法制体系提供理论基础。 本文采取了规范分析法、案例分析法文献研究法和历史研究法对健康权的卫 生法保障进行探讨。 本文的主要内容有：第一，介绍健康权的基本理论、性质、分类，以及卫生 法保障健康权的意义；第二，介绍健康权的卫生立法现状，以及存在的问题，并 提出自己的见解；第三，从卫生执法的角度上，分析健康权的保障；第四，公民 健康权益受到侵害时，可以通过对危害健康权的事前救济、损害健康权的事后救 济以及侵害健康权公益诉讼等途径救济。 本研究得出的结论：（1）我国应在宪法中确立健康权，并制定卫生基本法； （2）卫生法保障健康权是赋权性保障、受益性保障与防范性保障，能真正促进 健康权的实现；（3）强化危害健康权事前救济机制，确立健康权的公益诉讼制度。 关键词：健康权；卫生立法保障；卫生执法保障；卫生司法保障 Studyon Protection of Health Rightin Health Law Abstract Health is the basic human rights and can get legal acknowledgement, protection and relief Civil, criminal and other legal protection is passive protection, namely afterward relief, and cant realize the right to health protection. While, the protection of the health law is actively protection, that is, prior relief, and can truly realize the right to health protection. In recent years, a lot of public health incidents that damage peoples right to health, have occurred. Based on this, this study is on the basis of research at home and abroad for reference, and research the right to health from the perspective of health law protection. Its purpose is to elaborate the necessity and feasibility of the development of Basic Law of Health, and specify the right to health; put forward our own proposals and countermeasures combining Chinas national conditions, to provide a basis for establishing a sound and unified health legal system. We adopted a normative analysis, case analysis, documentary research and historical research to explore health law to protect the right to health.
