摘 要 夫妻共同债务是指夫妻双方当事人在婚姻关系存续期间用于夫妻共同生活， 共同生产经营的，由夫妻双方的意思表示或者一方签字另一方事后追认的所欠 的第三人即债权人的债务。今年年初的新司法解释出台之后，比较大的解决了 之前《婚姻法解释（二)》当中较为争议的第二十四条中的只要是在夫妻双方的 婚姻存续期间的一方或者双方所负的债务就属于夫妻共同债务，新的司法解释 出台在一定程度上解决了一方当事人不再承担由另一方的x，吸毒等个人问题 的所负债务。但是，与此同时，新的立法同时也存在一定的问题。所以，本篇 论文在结合了有关夫妻共同债务的认定的基础上，结合之前《婚姻法解释（二)》 第二十四条存在的争议，以及分析了新的司法解释中的有关立法解释，借鉴了 美国、德国、瑞士等相关国家的立法,结合我国国情，提出完善了有关夫妻共同 债务的立法建议，对日常家事代理纳入立法提出来相应的观点。 关键词：夫妻共同债务；新的司法解释；二十四条；日常家事代理 Abstract The common debt of a husband and wife refers to the debt of the third party, the creditor, for the joint production and operation of the husband and wife during the duration of the marriage relationship and the joint production and operation of the husband and wife. After the introduct ion of the newjudicial interpretation at the beginning of this year, the twenty-fourth of the more controversial issues in the previous interpretation of the marriage law (two) are the common debts of the couple, or the debts of both parties, and the new judicial interpretation has been solved to a certain extent. A party is no longer liable for any personal problems such as gambling, drug abuse and other personal problems. However, at the same time, there are some problems in the new legislation. Therefore, on the basis of the identification of the common debt of the husband and wife, this paper combines the twenty-fourth disputes in the previous interpretation of the marriage law (two), and analyzes the relevant legislative explanations in the new judicial interpretation, drawing on the legislation of the countries of the United States, Germany, Switzerland and other countries, and combining with the national conditions of our country. The legislative proposals on the joint debts of husband and wife have been perfected, and the corresponding views have been put into the legislation of family affairs agency.
