Fidic合同(英文)通用条款(EPC) General ConditionsGeneral Provisions1.1 DefinitionsIn the Conditions of Contract (these Conditions), which includeParticular Conditions and these General Conditions, the followingwords and expressions shall have the meanings stated. Wordsindicating persons or parties include corporations and other legalentities, except where the context requires otherwise.1.1.1 The Contract1.1.1.1 Contract means the Contract Agreement, these Conditions, theEmployers Requirements, the Tender, and the further documents (ifany) which are listed in the Contract Agreement.1.1.1.2 Contract Agreement means the contract agreement referred to inSub-Clause 1.6 [Contract Agreement], including any annexedmemoranda.1.1.1.3 Employers Requirements means the document entitled employersrequirements, as included in the Contract, and any additions andmodifications to such document in accordance with the Contract.Such document specifies the purpose, scope, and/or design and/orother technical criteria, for the Works.1.1.1.4 Tender means the Contractors signed offer for the Works and allother documents which the Contractor submitted therewith (otherthan these Conditions and the Employers Requirements, if sosubmitted), as included in the Contract1.1.1.5 Performance Guarantees and Schedule of Payments mean thedocuments so named (if any), as included in the Contract.1.1.2 Parties and Persons1.1.2.1 Party means the Employer or the Contractor, as the contextrequires.1.1.2.2 Employer means the person named as employer in the ContractAgreement and the legal successors in title to this person.1.1.2.3 Contractor means the person(s) named as contractor in theContract Agreement and the legal successors in title to thisperson(s).1.1.2.4 Employers Representative means the person named by theEmployer in the Contract or appointed from time to time by theEmployer under Sub-Clause 3.1 [The Employers Representative],who acts on behalf of the Employer.1.1.2.5
