PAGE 论无人驾驶汽车的法律监管 摘要：作为未来汽车的发展方向，我国的无人驾驶汽车已经开始进行道路测试。然而，无人驾驶汽车加大生产运用的同时，我们发现面临着对其监管无法可依，现行法律已经无法及时对其进行规制的状况。因此，为了给无人驾驶汽车上路提供一个良好的法治环境，我国需要立法先行，进行合理的立法，建立无人驾驶汽车法律监管体系。本文首先明确了无人驾驶汽车的定义及分类，然后分析我国无人驾驶汽车上路对现行法律在行政、民事、刑事方面的挑战，其次通过总结目前其他国家关于无人驾驶汽车的先进立法，找到值得参考的成果。以目前我国无人驾驶汽车上路面临的立法空白为基础，本文基于对我国现行法律的研究，试提出我国无人驾驶汽车的法律监管建议：（1）规范无人驾驶汽车取得上路资格的条件，完善其道路通行权。（2）确定无人驾驶汽车侵权时民事责任主体及责任分配，保障公民的网络信息安全和隐私权。（3）明确无人驾驶汽车交通肇事时入刑主体及如何进行定罪处理。 关键词：无人驾驶汽车，法律监管，立法建议 On the Legal Supervision of Driverless Cars Abstract：As the direction of future cars development, driverless cars has begun to carry out road test in China. However, with the increase of production and application of driverless cars, we find that we are facing the situation that we can’t abide by the regulation and the current law can’t regulate it in time. Therefore, in order to provide a good legal environment for the use of driverless cars, we need legislation first, moderate legislation, and a legal supervision system for driverless cars. This article first defined the definition and classification of driverless cars. Secondly, it analyzes the current law in administration, civil and criminal aspects. And then , through the analysis of the advanced legislation on driverless cars in other countries, we can find the achievements that are worth learning.Based on the current legislative gaps in the filed of driverless cars in China, on the basis of studying the current law of our country, this article tries to put forward some suggestions on the legal supervision of driverless cars: (1) To standardize the conditions for driverless cars to obtain on road qualification and improve their wayleave. (2) Define the subject of civil liability and the distribution of liability in case of infringement of driverless cars, effectively protect citizens network information security and privacy rights.
