我国婚内强奸行为的刑法定性问题研究 摘要：婚内强奸是指婚姻存续期间，丈夫施加于妻子的违背其性自由选择权的强迫性性关系的行为。婚内强奸作为一种隐蔽又客观存在的性暴力严重摧残妇女的身心健康，给社会造成恶劣影响。但婚内存不存在强奸，婚内强奸是否构成犯罪，一直以来社会各界都存在着不同的声音。国际上部分国家已经把婚内强奸进行入罪化，但国内法律并没有对该问题进行明确阐释和规定，且刑法学界在理论上也一直存在争议，立法对此却不予回应，这就在司法实务中导致难以把握的不确定性困境，导致同案不同判这种有损司法权威性的情况出现。本文立足于婚内强奸相关案例，对刑法学界对婚内强奸入罪的不同观点进行阐述和评析，对婚内强奸的行为定性做一个简要的论述。 关键词：婚内强奸；性自主权；强奸罪；行为定性 A study on the criminal qualification of marital rape in China Abstract: Marital rape is an act of forced sexual intercourse by a husband against his wife during the course of their marriage against her sexual freedom to choose. Marital rape, as a kind of hidden and objective sexual violence, severely destroys womens physical and mental health and has a bad impact on the society. However, there is no rape in marriage, and there have been different voices from all walks of life about whether rape within marriage constitutes a crime. International on the part of the country has taken the marital rape into sin, but the domestic law did not articulate and provisions about this problem, and the criminal law educational world also has been controversial in theory, legislation would not respond to this, its in the judicial practice, making it difficult to grasp the uncertainty of the dilemma leads to different connection found the damage to the judicial authority. Based on the cases of marital rape, this paper expounds and analyzes the different viewpoints of the criminal law circle on the crime of marital rape, and makes a brief discussion on the qualitative behavior of marital rape.
