China's "Anti Unfair Competition Law" takes the protection of consumers' rights and interests as one of the legislative objectives, and takes whether the legitimate rights and interests of consumers are damaged as one of the identification standards of unfair competition. However, due to the unclear concept of consumers and the lack of direct relief means, there is a gap between the legislation and practice of the law. The consumer standard in the identification of unfair competition should not apply the concept of consumer in the consumer protection law. At the same time, in the judicial relief, consumers should be given the limited right to sue in the name of consumer organizations. Only in this way can we better reflect the legislative purpose of the anti unfair competition law.
