论知情同意之说明义务——以《侵权责任法》为重点展开的研究的中期报告 摘要： 知情同意是现代医疗伦理学和法律中一个重要概念，旨在保护病人的自主权和自由意志。侵权责任法对知情同意做出了详细规定，明确了医疗机构和医务人员的告知和说明义务，以及病人的同意义务。本文在分析了知情同意的概念、特点及其在医疗领域中的应用的基础上，聚焦于《侵权责任法》中关于知情同意的规定，分析了医务人员告知和说明义务的内涵和范围，阐述了病人同意的要件和条件，探讨了医务人员违反告知说明义务、病人同意存在瑕疵等情况下可能产生的侵权责任，以及如何确定侵权责任的承担方式和范围。本文还对现行知情同意制度中存在的问题和不足进行了探讨，包括医务人员告知的不足、病人自由意志的限制，以及知情同意内容和范围的界定问题等，提出了相关建议和改进措施。 关键词：知情同意；侵权责任法；告知说明义务；合法同意；瑕疵同意；侵权责任承担 Abstract: Informed consent is an important concept in modern medical ethics and law, aimed at protecting the patients autonomy and free will. The Tort Liability Law provides detailed provisions on informed consent, clarifying the duty of medical institutions and medical personnel to inform and explain, as well as the patients obligation to consent. Based on the analysis of the concepts, characteristics and application of informed consent in the medical field, this paper focuses on the provisions of the Tort Liability Law on informed consent, analyzes the connotation and scope of the duty of medical personnel to inform and explain, expounds the requirements and conditions for patients consent, explores the possible tort liability that may arise when medical personnel violate their duty of informing and explaining or when the patients consent is flawed, and discusses how to determine the manner and extent of tort liability. This paper also discusses the problems and shortcomings of the current informed consent system, including insufficient information provided by medical personnel, limitations on the patients freedom of will, and issues regarding the definition and scope of informed consent, and proposes relevant suggestions and improvement measures.
