Appendix 2 Operation of Residential Care Homes for the Elderly in Non-domestic Buildings Paragraph 6.3.2 of the Code of Practice for Residential Care Homes (Elderly s) stipulates that “A residential care home for the elderly shall not be situated in a non-domestic building or in the non-domestic part of a composite building if objection is raised by the Buildings Department to the change in use”. In order to expedite the processing of the application for licence/ of exemption, we take this opportunity to remind you that you should consider engaging or consulting an authorized or professional consultants concerned to submit application to the Buildings Department for change of use of the proposed premises. In addition, if there is al tion or addition works, approval and consent from the Buildings Authority should also be obtained for compliance with the requirements laid down in the Buildings Ordinance, Cap. 123 and its subsidiary regulations. As soon as you have obtained the permission from the Buildings Department and the requirements laid down in the Residential Care Homes (Elderly s) Ordinance, Cap. 459 and its subsidiary regulations are met, this Department will consider issuing a licence/ of exemption.
