刑事被告人证明责任研究的中期报告 摘要： 刑事被告人证明责任是在刑法中的一个基本问题，也是刑事审判的中心问题之一。本文对刑事被告人证明责任的研究进行了一定的调查和探讨。结合实例，探讨了刑事被告人证明责任的几个方面：证明标准、证据构成、证明方法、证明运用以及证明难点和解决方法等。根据调查结果，提出了如下结论：刑事被告人证明责任的标准应当是证明的根据可信度；证据构成应当是证明被控罪名事实的证据必须具备的要素；证明方法应当是在法定证据原则的基础上进行，证明运用应当是根据事实与法律规定相结合，证明难点应当是在具体案例中具体分析，解决方法应当是采用综合排除原则。 关键词： 刑事被告人、证明责任、证明标准、证据构成、证明方法、证明运用、证明难点 Abstract: Criminal defendants responsibility for proving is a basic issue in criminal law, and it is also one of the central issues in criminal trials. This paper investigates and discusses the research on the criminal defendants responsibility for proving. With examples, we have explored several aspects of criminal defendants responsibility for proving, including the standard of proof, the composition of evidence, the methods of proof, the application of proof, and the difficulties in proof and solutions. Based on the survey results, the following conclusions are drawn: the standard of proof for criminal defendants responsibility should be based on the credibility of the evidence; the composition of evidence should include the necessary elements of proving the charged facts; the method of proof should be based on the legal principle of evidence, the application of proof should be based on the combination of facts and legal provisions, the difficulties in proof should be analyzed based on specific cases, and the solution to the difficulties should be based on the comprehensive exclusion principle.
