论农民环境权的宪法保护——以城市污染转移为视角的中期报告 摘要：本文基于我国环境保护的发展现状，从城市污染转移的视角出发，探讨了农民环境权的宪法保护问题。本文首先分析了我国现行环境法律规定的缺陷，指出法律保障不足，农民环境权保护难度较大。接着，本文结合城市污染转移的案例分析，指出污染转移造成的环境问题直接损害到农民及其家庭的环境权益，需要立法进行保护。最后，本文建立了符合我国国情的农民环境权保护机制，认为应加强宪法级别的农民环境权保护，以保障农民的合法权益。 关键词：农民环境权；城市污染转移；宪法保护 Abstract: Based on the development status of environmental protection in China, this paper explores the constitutional protection of farmers environmental rights from the perspective of urban pollution transfer. Firstly, the paper analyzes the defects of the current environmental laws and regulations in China, indicating that legal protection is insufficient and it is difficult to protect farmers environmental rights. Secondly, combined with the analysis of the case of urban pollution transfer, the paper points out that the environmental problems caused by pollution transfer directly harm the environmental rights and interests of farmers and their families, and legislation is needed to protect them. Finally, the paper establishes a mechanism for protecting farmers environmental rights that is in line with Chinas national conditions, and argues that constitutional-level protection of farmers environmental rights should be strengthened to protect their legitimate rights and interests.
