论互联网言论自由的法律规制

摘要

如果说，在协商民主相对完善、言论市场发育成熟的国家，规范互联网言论有更多先例可参、更多经验可鉴的话，那么在中国这样的市民社会欠发达、公民文化有待培育、公共领域不够健全的国家，网络表达自由边界的确立则需要处理更多的权益冲突、面临更加复杂的多种因素的考量。本文综合运用了文献研究法、调查研究法、对比分析法等对我国互联网言论自由的法律规制进行研究，按照提出问题、分析问题、解决问题的思路展开分析，主要是从法律的制定、法律的内容、政府对网络言论的隐形干预等方面提出了我国互联网言论自由法律规制方面存在的问题；基于此，并在借鉴德国、新加坡、美国这3个国家对于互联网言论自由法制建设的相关经验，并结合我国的基本国情，对标准化我国互联网言论保护的法律规制提出了一系列的建议。

ABSTRACT

IftherearemoreprecedentsandmoreexperienceinregulatingInternetspeechincountrieswithrelativelyperfectdeliberativedemocracyandmaturespeechmarket,thenincountriessuchasChina,wherecivilsocietyisunderdeveloped,civiccultureneedstobecultivated,andthepublicdomainisnotsoundenough,theestablishmentoffreeboundaryofnetworkexpressionneedstodealwithmoreconflictsofinterestandfacemorecomplexfactors.Thisarticlecomprehensivelyusestheliteratureresearchmethod,theinvestigationresearchmethod,thecontrastanalysismethodandsoontocarryontheresearchtoourcountryInternetfreedomofspeechlegalregulation,accordingtoraisesthequestion,theanalysisquestion,solvesthequestiontrainofthought,mainlyfromthelawformulation,thelawcontent,thegovernmentinvisibilityinterventiontothenetworkspeechandsoonaspectproposedourcountryInternetfreedomofspeechlegalregulationquestion;Basedonthis,thispaperdrawslessonsfromtheexperienceofGermany,SingaporeandtheUnitedStatesintheconstructionofthelegalsystemofInternetfreedomofspeech,andcombinesthebasicconditionsofourcountry,andputsforwardaseriesofsuggestionsonstandardizingthelegalregulationofInternetspeechprotectioninChina.
