Abstract:WiththeadventoftheInternetage,people’slifestyleshaveundergonemajorchanges.Asofmid-2019,therearenearly900millionInternetusersinChina,withanInternetpenetrationrateexceeding60%.Thepopularizationofnetworktechnologyhasbrokenthetraditionalformofworkdissemination.TheuseoftheInternettodisseminatetext,videoandotherworkshaslowcostandisnotrestrictedbytimeandspace.Everyonecanbeacreatorandpublisher.Atthesametime,newonlinecopyrightdisputesareconstantlyemerging.Inrecentyears,Chinascopyrightprotectionhasbeenstrengthened,buttherearestillmanyproblemsinlegalandjudicialpractice.

Thisarticlestartswiththeconceptandcharacteristicsofonlinecopyrightandanalyzestheelementsofonlinecopyrightinfringement.CollectingthelegislativehistoryandcurrentstatusofChinaslegislation,highlightingsomeoftheshortcomingsofjudicialpracticeinChinascopyrightlaw,similartotheinsufficientprotectionofcriminallaw,difficulttodeterminejurisdiction,inadequatedeterminationofinfringementstandards,lackofreasonableprotectionperiodanddifficulttoproveAndotherissues,theseissueshaveseriouslydamagedthelegitimateinterestsofcopyrightowners,causingmaterialandspiritualdamagetothem.Andbydrawingonthelegislativeexperienceofdevelopedcountries,Ihopemylegalsystemcanbemorecomplete,whilepreservingthepersonalrightsandpropertyrightsofcopyrightowners,wealsomakeapre-judgmentofwhatmayhappeninthefuture.Finally,Ihopethatthroughtheresearchofthisarticle,wecanprovideameaningfulreferencefortheprotectionoftherightsandinterestsofonlineworks.
