未成年人父母监护权撤销制度的研究

摘要：未成年人的身心健康发展尚未健全，社会阅历较浅，对于身边的不法侵害往往难以认识，即使有所认识，也因自身处于弱势地位而难以自我保护。因此，为了更好地保护未成年人人身、财产权益，我国设立了未成年人父母监护权撤销制度。由于制度本身设计的缺陷和传统观念的影响，导致该制度沉睡了几十年，并且近几年父母侵害未成年子女合法权益或拒不履行监护职责等事件时常发生，如何运用父母监护权撤销制度来保护未成年人合法权益再次得到关注。本文通过对未成年人父母监护权撤销制度的研究分析，从理论上对制度有较为全面的认识，并结合我国立法现状与司法实践分析该制度在适用上所出现的问题。结合域外在制度设计上现有的可行性措施，对我国未成年人父母监护权撤销制度的不足提出几点建议。

Abstract:Thephysicalandmentalhealthdevelopmentofminorsisnotyetsound,socialexperienceisrelativelyshallow,forthesideoftheillegalinfringementisoftendifficulttorecognize,evenifthereisawareness,butalsobecauseoftheirownweakpositionanddifficulttoprotectthemselves.Therefore,inordertobetterprotecttheminorspersonalandpropertyrightsandinterests,Chinahassetuptheminorsparentalcustodyrevocationsystem.Duetothedefectofsystemdesignandtheinfluenceoftraditionalideas,infringesuponthesystemintoadeepsleepfordecades,ledtotheparentsinrecentyears,suchasthelawfulrightsandinterestsofminorchildrenorrefusetofulfilltheirdutiesofguardianshipeventsoftenoccurs,howtousetheparentscustodyrevocationsystemtoprotectthelegitimaterightsandinterestsofminorsonceagainbecomeahottopicofsociety.Thisarticlethroughtotheminorsparentscustodysystemanalysis,letustosystemhaveamorecomprehensiveunderstanding,andcombinedwithourcountrypresentlegislationandjudicialpracticeanalysisontheapplyofthissystem,andthenputsforwardoutsidehastheexistingofthemeasuresinthesystemdesign,combiningourparentscustodyofminorstocancelthesystemputforwardsomeSuggestions.
