我国环境行政处罚自由裁量权的研究

摘要：随着社会和经济的发展，我国在环境上问题越来越严重。行政处罚对我国的环境治理起着重要意义。自行政处罚法正式出台实行至今，在行政处罚权力、行政工作的效率和行政执法等方面都有明显的进步。但行政自由裁量权在行使过程中，对于滥用现象并不少见，甚至会直接导致国家机关在人民群众印象的威信和信誉也会大打折扣。笔者首先对环境行政处罚自由裁量权进行概述介绍，在该部分主要从环境行政处罚自由裁量权的含义和存在的必要性切入谈论，对所认识的环境行政处罚自由裁量权的认识进行阐述。第二部分则是针对环境行政处罚自由裁量权存在的问题进行收集整理分析，譬如环境行政处罚的执法部门监督不到位和执法人员素质水平欠缺等。对此从法律法规、行政处罚监督管理制度和行政处罚执法人员的自身素质上提出相应的解决对策的建议，对我国环境行政处罚自由裁量权进行探讨和研究。

Abstract:Withthedevelopmentofsocietyandeconomy,environmentalproblemsinourcountryarebecomingmoreandmoreserious.AdministrativepenaltyplaysanimportantroleinChinasenvironmentalgovernance.Sincetheimplementationofthelawontheadministrativepunishment,therehasbeenobviousprogressinthepowerofadministrativepunishment,theefficiencyofadministrativeworkandadministrativelawenforcement.andadministrativelawenforcement.However,intheexerciseofadministrativediscretion,itisnotuncommontobausethephenomenon,anevendirectlyleadtothestateorgansinthepublicimpressionoftheprestigeandcredibilitywillbegreatlyreduced.Firstly,theauthorgivesanoverviewoftheenvironmentaladministrativepenaltydiscretion.Inthispart,theauthormainlydiscussesthemeaningandnecessityoftheenvironmentaladministrativepenaltydiscretionandexpoundstheunderstandingoftheenvironmentaladministrativepenaltydiscretion.Thesecondpartcollectsandanalyzestheproblemexstinginthediscrtetionofenvironmentaladministrativepenalty,suchastheseriousabusecausedbythepowerattributeofthediscretionofenvironmentaladministrativepenalty,theinsufficientsupervisionofadministrativepenaltyleveloflawenforcementpersonnel.Inthispaper,theathorputsforwardthecorrespondingcountermeasuresformtheaspectsoflawsandregulations,administrativepenaltysuoervisionandmanagementsystemandthequaltyofadministrati
