浅析我国破产重整制度

摘要:破产重整制度是我国在社会主义市场经济和企业发展中制定的一项公平解

决企业债务的制度。让企业能够在破产中清理自身债务，帮助其进行新的发展。

对破产而言，企业破产涉及到的利益关系众多，一旦在破产中不能达到各方诉求，

就容易出现因破产制度引发各方矛盾，这就显得破产重整制度的重要性。通过破

产重整制度制定，实际上是让企业在破产中重整，优化各方利益，平衡各方利益，

避免因利益不平衡引发的矛盾和其他新的问题。在我国法律健全过程中，也会尊

重各方利益，注重公平与效率。由此，才有了本文对我国破产重整制度的分析和

研究。

enterprisedebtsformulatedinthesocialistmarketeconomyandenterprise

developmentinChina.Letenterprisesclearuptheirdebtsinbankruptcyandhelp

themdevelopinanewway.Asfarasbankruptcyisconcerned,therearemany

interestsinvolvedinenterprisebankruptcy.Oncethedemandsofallpartiescannotbe

metinbankruptcy,itiseasytocausecontradictionsamongallpartiesbecauseof

bankruptcysystem,whichshowstheimportanceofadequatebankruptcysystem.The

formulationofbankruptcyreorganizationsystemisactuallytoletenterprises

reorganizeinbankruptcy,optimizetheinterestsofallparties,balancetheinterestsof

allparties,andavoidcontradictionsandothernewproblemscausedbytheimbalance

ofinterests.Intheprocessofperfectingourlaw,wewillrespecttheinterestsofall

partiesandpayattentiontofairnessandefficiency.Thus,thispaperhastheanalysis

andResearchonthebankruptcyreorganizationsystemofourcountry.
