1(a)Statutoryinterpretation

Inordertoapplyanypieceoflegislation,judgeshavetodetermineitsmeaning.Inotherwords,theyarerequiredtointerpret

thestatutebeforetheminordertogiveitmeaning.Thedifficulty,however,isthatthewordsinstatutesdonotspeakfor

themselvesandinterpretationisanactiveprocess,andatleastpotentiallyasubjectiveonedependingonthesituationofthe

whoisdoingtheinterpreting.

Judgeshaveconsiderablepowerindecidingtheactualmeaningofstatutes,especiallywhentheyareabletodeployanumberof

competing,nottosaycontradictory,mechanismsfordecidingthemeaningofthestatutebeforethem.Thereare,essentially,two

contrastingviewsastohowjudgesshouldgoaboutdeterminingthemeaningofastatute–therestrictive,literalapproachand

themorepermissive,purposiveapproach.

(b)Theliteralapproach

TheliteralapproachisdominantintheEnglishlegalsystem,althoughitisnotwithoutcritics,anddevicesdoexistfor

circumventingitwhenitisseenastoorestrictive.Thisviewofjudicialinterpretationholdsthatthejudgeshouldlookprimarily

tothewordsofthelegislationinordertoconstrueitsmeaningand,exceptintheverylimitedcircumstancesconsideredbelow,

shouldnotlookoutsideof,orbehind,thelegislationinanattempttofinditsmeaning.
