1.甲方（买方/出租方/委托方）：

合同简介：

甲乙双方根据《中华人民共和国合同法》及相关法律法规的规定，遵循平等、自愿、公平、诚实信用的原则，经友好协商，就甲方借给乙方一定金额的资金事宜，达成如下分期借款合同。

甲乙双方同意，甲方借给乙方人民币×××元整（大写：人民币×××元整），用于乙方的经营周转。借款期限为××个月，自借出之日起计算。

甲乙双方约定，乙方每月还款金额为人民币×××元整，共分为××期还款。乙方应按照约定的还款期限和还款金额，按时还款。

甲乙双方furtheragreethatintheeventofanydefaultbyBorrowerunderthisAgreement,LendershallbeentitledtorecoverfromBorrowerallcostsandexpenses,includingbutnotlimitedtoattorneysfees,courtcostsandotherlegalfees,incurredbyLenderinconnectionwiththeenforcementofLendersrightsunderthisAgreementorotherwise.

ThisAgreementmaynotbeassignedbyeitherpartywithoutthepriorwrittenconsentoftheotherparty,exceptthatLendermayassignthisAgreementtoasuccessorininterestinconnectionwiththesaleortransferoftheLoan.

ThisAgreementconstitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatterhereofandsupersedesallprioragreements,understandings,negotiationsanddiscussions,whetheroralorwritten,oftheparties.

AnyamendmentormodificationofthisAgreementoradditionalobligationassumedbyeitherpartyinconnectionwiththisAgreementshallbebindingonlyifevidencedinwritingsignedbyeachpartyoranauthorizedrepresentativeofeachparty.

IfanyprovisionofthisAgreementisheldtobeinvalidorunenforceable,suchprovisionshallbeenforcedtothemaximumextentpossibleandtheotherprovisionsofthisAgreementshallremaininfullforceandeffect.

ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthePeoplesRepublicofChina.

AnydisputesarisingoutoforinconnectionwiththisAgreementshallbesubmittedtothePeoplesCourthavingjurisdictionovertheplacewheretheLendersregisteredofficeislocatedforresolution.
