破产 (bankruptcy)作为商品经济社会里一个非常普遍的社会现象，在社会
不同领域中使用有不同的含义。日本学者石川明认为，破产一词有两种含义:第
一，作为程序和制度的破产。即将倒产制度解释为遵照破产法典的裁判上处理的
程序或制度 (程序性的破产概念)。第二，在表示作为债务者之经济破绽状态之
破产意义上使用 (状态性的破产概念)。，1在〔经济生活中破产是指债务人的财务
状况到了事业倒闭、倾家荡产的地步，经济上已经无法维持。而破产概念在法律
上是指债务人不能清偿债务时所适用的偿债程序和该程序终结以后债务人的身
