景德镇陶瓷原产地名称保护调研分析.docVIP

摘 要 “景德镇”是我国最有代表性的，颇具国际竞争力的原产地名称，保护景德镇原产地名称对于弘扬我国民族传统文化，促进陶瓷工业的发展，维护消费者的利益具有十分重要的作用。为防止“景德镇瓷器”这个弥足珍贵的原产地名称继续遭到非法侵害，本文对景德镇瓷器原产地名称保护工作进行了调研分析。第一部分是与原产地名称的相关概念及法律保护等研究综述。随后第二部分从景德镇陶瓷原产地名称的历史由来入手，深入探究该原产地名称的深厚底蕴。第三部分和第四部分分别通过对景德镇陶瓷原产地名称保护状况的调研和保护工作效果的评析，总结工作中的成功经验，吸取保护过程中的教训。论文最后，在前面调研分析的基础上，提出了在世贸组织框架内能够做到的一些切实可行的保护对策，如坚持将原产地名称纳入商标法中给予法律保护；强化政府职能，监督企业，保证拥有原产地名称的产品质量；向陶瓷企业普及原产地名称保护的知识，提高整个原产地地区的维权保护意识等。 【关键词】景德镇陶瓷 原产地名称 保护 对策 Abstract “Jingdezhen” is one of the most representative appellations of origin which full of competitive capability in our country. The protection of this appellation of origin will not only enhance the development of the traditional culture of our nation and the ceramic industry, but also preserve the consumer’s right. This article aims at making some investigation and analysis to the protection of Jingdezhen’s original appellation, the objective of the first part is to make some brief introduction, the second part emphasizes on historical origin of Jingdezhen ceramics’ appellation of origin, and thereby studies the profound knowledge implied in it. Then in the third and the fourth part, through the investigation of the protection of appellations of origin and the evaluation of effect of the protection work, we summarize the experience and learn a lot from this. In the final part, on the basis of the investigation and analysis, the article suggests some practical and feasible protection countermeasures according to the principles made by the World Trade Organization, such as we should try to give it the legal protection by the trademark law; we must strengthen the government function, surveil the enterprise, guaranteed the quality of porcelain produced in Jingdezhen; The management and supervision department must popularize the knowledges of appellations of origin protection to the ceramic enterprises, in order to enhance the protection consciousness in the whole area and so on. 【Key Words】Jingdezhen ceramics; Appellations of origin; Prot
