南京航空航天大学硕士学位论文  摘  要  近年来，“三聚氰胺”、“瘦肉精”、“塑化剂”等系列食品安全事件的发生 标示着我国食品安全问题依然严峻，而探究西方国家食品安全监管体制的经验，不 难发现第三方作为重要的参与主体已得到诸多国家的认可。本研究正是基于以上背 景对我国食品安全监管体制存在的问题进行分析和探索，希冀进一步完善我国食品 安全监管体制。 本文认为食品安全监管体制中第三方参与的缺失或不到位是当前食品安全监 管问题屡屡发生的症结所在。通过对我国当前食品安全监管体制运行现状的分析， 揭示其存在的不足，并且通过博弈理论分析和MATLAB7.0模拟实验，论证第三方 参与食品安全监管的有效性，进而提出我国食品安全监管体制的变革路径必须包括 第三方主体。且对监管体制的变革路径、变革方式指明了方向，提出通过食品安全 监管体制的渐进性改革，逐步迈向相对单一的第三方充分参与的食品安全监管体 系，在这一体系变革中必须通过完善制度保障，明确第三方参与的法律地位；通过 公共协商，型构第三方参与的协商机制；建立第三方参与的信息处理系统，畅通信 息渠道；培育第三方主体，塑造其参与能力来完善我国食品安全监管体制，提升食 品安全监管的效果。最后，对新的食品安全监管体系运行过程中可能遇到的问题进 行了剖析。 关键词：第三方参与，食品安全，监管体制 I 第三方参与的食品安全监管体制研究 ABSTRACT In recent years, the melamine, lean fine, plasticizing agent, etc. Series of food safety accidents happened in China marked the food safety problem is still severe, and explored the western national food safety regulatory system of experience, it is not difficult to find that the third party as an important participation main body has got many national recognition.
