Arts The study on the protection of digital publishing copyright of China  Candidate: Zhang  Haiwang  Supervisor: Prof. Tian  Jianping  Academic Degree Applied for: Master of Arts Specialty: Communication University: Hebei University Date of Oral Examination: June, 2012 摘 摘  要 要  数字出版方兴未艾，版权保护问题是其发展的瓶颈之一，直接影响到数字出版的赢 利、版权人利益的保护和参与的积极性，间接关系到我国知识产权保护体系的完善、知 识经济的发展与文化软实力的提高。目前，我国数字出版版权保护在授权、法律保护以 及如何应对新技术带来的挑战等方面都存在着问题。基于以上关于挑战与问题的分析， 笔者认为，要保护数字出版版权，须探索多样化的授权方式；修订和完善我国现行的《著 作权法》，并根据国情适当提高版权法的国际适用度；对技术保护措施的使用，应找到 版权人和使用者的利益平衡点；要加强数字出版版权保护的行政执法力度，充分发挥政 府职能。  关键词  数字出版  版权  保护  利益平衡  I Abstract Abstract Digital publishing is in the ascendant, copyright protection is one of its development bottleneck, directly affects the profitability of the digital publishing, also effects the profit and enthusiasm of the owner of copyright, indirectly relates to the intellectual property rights protection system, the development of knowledge economy and Culture Soft Strength of China. At present, Chinas digital publishing copyright protection is not completely in authorized, legal protection and how to respond to the challenges of new technology. Based on the analysis of the problems, the author propound some advice on how to protect digital publishing copyright in authorized, legal protection, the technical protection, government administrative protection and ethical awareness. To protect the copyright of digital publishing, we must diversify the way of authorization; revise and perfect our current copyright law, and the copyright law shall apply an appropriate increase in the international level according to the conditions; when using of technology protection measures, we should find the balance between the user and the copyright
