知识产权评估小论文 姓名： 陈国山 年级： 2011级 班级：法律硕士三班 学号：20110351011015  商标评估问题研究 摘要：商标评估是指由专业机构和人员，按照特定的目的，遵循客观经济规律和公正的原则，依照国家规定的法定标准和程序、运用科学的方法，以统一的货币 单位，对商标的现有价值进行评定与估算。它是市场经济条件下客观存在的一项动态化、市场化的社会活动，对于量化企业资产总额、提升企业形象、实现企业品牌战略管理目标有着巨大的作用。然而因为商标评估市场没有相关法律法规的调整（仅有的两部政府规章《商标评估机构管理暂行办法》、《企业商标管理若干规定》也因为中国加入世贸组织而被废止），如今已经呈现出各种各样的隐患，比如评估标准随意性大、评估结果可靠性差、评估机构专业水平欠缺等现实问题亟待解决。本文首先介绍商标评估市场潜力和现状，进一步提出商标评估市场所存在的理论和现实问题，最后对于完善商标评估市场提出一些意见和建议。 关键词：商标评估 评估方法 影响因素 对策 Abstract: Trademark assessment refers to making a valuation and calculation of a given Trademark with a certainty kind of currency by several specialists. They have to accomplish their tasks in accordance with a certain purpose and legal procedures, as well as follow the objectively laws of economics and the principle of fairness. Trademark assessment is a kind of dynamic and marketing social activity, which exists objectively under the market economy. Trademark makes great contributions in procedures of quantifying of enterprise asset, what’s more, sometimes image of a certain enterprise and achieving of the brand strategy management based on the Trademark assessment to some degree. However, short of relative regulations in the market of Trademark Assessment, we are faced with lots of tough problems of different kinds, such as rules of assessment in intense disorder, outcome of assessment is reliability poor, our assessment agencies are lack of professional capabilities.
