Analyzethepresentutilitymodelexaminationsystemandsomefollowingproblems throughcitingsomerepresentativecases,andproposesomesuggestionsbyreferencing toforeigncountrysexperiences.Inordertohaveareasonablejudgementandeffective protectionfortheutilitymodelpatent,thesesuggestionsareasfollows.First, strengthenthepublicityworkoftheutilitymodelexaminationsystem,andsothepeople knowtheprocessoftheapplicationbeinggranted.Second,toenhancethepatent applicationquality,advisetheapplicantsearchthepertinentpriorartbeforefilingutility model.Third,improvethesearchreportsystemtobuildcreditstandingexamination system.Finally,perfectingtheutilitymodelexaminationsystemmustbebasedonour andmakethePatentLawandrelevantsystemservicetoits owneconomicdevelopment, countyseconomyprofit.
