论行政执法证据与刑事司法证据的衔接 摘 要 行政法与刑法在调整对象上存在的交叉与转化关系，决定了这两个部门法 之间的衔接关系。其中，证据作为行政执法与刑事司法的共同基础，其协调、 衔接使用情况对于行政执法与刑事司法的衔接而言，就显得尤为重要。一方面 由于行政执法证据与刑事司法证据在收集主体、收集程序以及证据总量等方面 的差异，导致了其衔接存在障碍；另一方面行政执法证据与刑事司法证据作为 证据本身，具有证据属性、证据形式方面的相同或类似之处，这又为二者的衔 接提供了可能性，同时执法实践也要求二者建立衔接路径。因而探讨行政执法 证据与刑事司法证据的衔接路径，协调处理二者衔接的障碍，使得行政执法证 据通过一定方式可以在刑事司法程序中运用，成为行政执法与刑事司法衔接的 又一研究重点。总体而言，行政执法证据与刑事司法证据的衔接路径可以分为 两种方式：一是在现有法律体系内梳理相关法律制度，明确二者关系及法律地 位；二是通过立法的方式建立行政执法专职联络员制度衔接行政执法证据与刑 事司法证据。 关键词：行政执法证据；刑事司法证据；衔接必要性；衔接路径 On the Convergence of Administrative Law Enforcement Evidence and Criminal Justice Evidence Abstract The cross and transformation relationship existing in the adjustment object of administrative law and criminal law, determines the connection relationship between the two departments of law. Among them, the evidence as a common basis of administrate law enforcement and criminal justice, its coordination, convergence usage, it is particularly important for the convergence of administrative law enforcement and criminal justice. On the one hand, because of differences in the collection subject, collection procedure and the amount of evidence in administrative law enforcement evidence and criminal justice evidence, causes its convergence obstacles; On the other hand, administrative law enforcement evidence and criminal justice evidence as evidence itself, has the same or similar place in the attribute of evidence and forms of evidence, which in turn provides a possibility of both cohesion and at the same time law enforcement practice also requires the convergence path of them is established.
