Ltd, Ningbo 315010 ， China ） Abstract : While the EPC contract is adopted for large power projects as an advanced construction organization mode, it is found that under the EPC mode, the position of the owner and the role he plays are often ambiguous due to lack of ’ systematic theoretical support. In practice, the owner s rights are prone to be handicapped or marginalized. This ’ ’ practice increases the owner s risk and exerts negative effects on the contract execution and realization of the owner s interest, and at the same time, prevents the mode from sound development. This paper, based upon thorough analysis ’ of the owner s rights, discusses the current situation of the EPC application in China, compares EPC with FIDIC, and finally puts forward suggestions on the counter measures and solutions.
