马克思法哲学批判理论的当代诠释 摘 要 哲学是时代精神的精华，马克思的法哲学研究密切关注自己时 代所提出的种种问题，使其法哲学理论成为时代精神的体现。本文 力图在综合学术界研究成果的基础上，从马克思的社会存在理论这 一视阈出发，采用历史与逻辑相统一的方法，在与近现代法哲学转 型大背景的横向对比中，重点探讨马克思法哲学批判理论的历史演 进、逻辑展开及其当代价值。 本文分三部分展开： 第一部分 马克思法哲学批判理论的历史演进。马克思的法哲 学思想植根于西方的土壤，是在批判近代法的形而上学的基础上形 成的，是一种批判形态的法哲学。 第二部分 马克思法哲学批判理论的逻辑展开。立足于马克思 对近代法的形而上学基础的颠覆，阐述马克思法哲学理论的本体论 内涵、价值论成果、方法论视阈。 第三部分 马克思法哲学批判理论的当代意义。分析当代法哲 学的走向及其问题、当代人的异化生存境况、当代中国法治建设， 突显马克思法哲学理论的时代意义。 关键词：法哲学 形而上学 现代性 社会存在理论 法治 The Contemporary Interpretation of Marxs Legal Philosophy Critical Theory Abstract Philosophy is the essence of the era spirit. The study of Marxs legal Philosophy paid close attention to all sorts of problems of their own times. On the base of Marxs theory of social existence, this paper, using the historic and logic analytic methods, and under the horizontal contrast background of conversion of modern legal Philosophy, seeks to summarize the achievements of academic research, whats more, it focus on the critical theory of historical evolution of Marxs legal Philosophy, the logical start and contemporary values. This paper can be divided into three parts: The first part, the historical evolution of Marxs legal Philosophy critical theory; The second part, the logical start of Marxs legal Philosophy critical theory; The third part, the contemporary significance of Marxs legal Philosophy critical theory.
