摘 要 公益拆迁，是指拆迁人出于公共目的，为满足公共利益需要，在政府许可后， 依照法律规定的权限和程序，强制拆除建设用地范围内的房屋及其附属物，并对 该范围内的居民或者单位进行合理补偿或安置，以取得该建设用地使用权的行为， 具有公共目的性、强制性、补偿性、房地权属转移性等特征。目前，在我国尚无 专门的公益拆迁制度，在理论界对此进行系统研究的亦不太多。但是，随着我国 现行的城市房屋拆迁制度在立法和运行层面的问题不断显现，对城市房屋拆迁分 流问题进行研究，特别是对公益拆迁进行深入研究已是刻不容缓。有鉴于此，首 先从我国建立公益拆迁制度的必要性入手，深入分析了我国现行城市房屋拆迁制 度存在的种种问题，指出实行拆迁分流、建立公益拆迁制度是解决我国城市房屋 拆迁中诸多问题的现实需要。其次，对公益拆迁的相关基础理论进行了初步研究， 探讨了公共利益的界定、公正补偿及正当程序等基础问题。最后，通过考察中外 立法及司法实践，提出了在我国设立公益拆迁制度的设想，对我国公益拆迁具体 制度的构建提出了相关建议。 关键词：公益拆迁；补偿；建议 I Abstract Relocation for public benefit means the conduct that the person who executes the pull-down of the original home and the relocation goes for public purpose and satisfies with the need of public interest, after getting the governmental permission, according to legal authority and procedures, executes mandatory dismantling the houses and their accessories in the range of land used for building , then reasonably compensates or resettles for the residents or units within this range, accordingly acquires the right to the use of land used for building, which is characterized with public purpose, enforceability, compensatory nature and transfer of ownership of reality. Nowadays, there is no special system of public relocation in our country until now, and there are few systematic studies on this topic in the circle of law theory.
