论我国保险监管法律制度完善-毕业论文.docVIP

摘　 要　 保险与国民经济的稳定发展和人民生活的安定密切相关，是社会的“稳 定器”。中国的保险业正以高速的发展让世界瞩目，在这种背景下，原有的保 险监管以及保险监管法律制度已经明显不适应保险业的发展要求，保险监管 的立法虽初具规模，但整体的保险监管法律还很不完善，矛盾缺漏的条文很 多，实施起来也缺乏可操作性，还没有形成系统化的监管法制体系，与保险 业对有效监管的要求相去甚远。本文对我国保险监管制度的法制现状及存在 的问题进行了深入的分析，并借鉴世界各国保险监管的先进经验，提出了完 善我国保险监管制度的方法及具体建议。　 本文共五章：　 第一章“保险监管概述”，主要论述了保险监管的基本理论。论述了保险 监管的含义及目标、原则、方式、内容等，肯定了保险监管的必要性和重要 性，为后文分析提供理论基础。　 第二章“发达国家的保险监管制度及对我国的借鉴意义”。通过对美国、 英国、德国、日本这四个国家保险监管制度的研究，力求揭示隐藏在差异背 后的共性和发展趋势，以其为我国保险监管制度的改革和完善提供启示和借 鉴。　 第三章“我国保险监管法律制度的现状和存在的问题”。本章主要论述了 我国保险监管制度的现状，并从三个方面指出了现行保险监管制度存在的问 题。　 第四章“完善我国保险监管法律制度的建议”。本章分为二部分，第一部 分提出完善保险监管制度体系的意见，主要是指立法的完善，第二部分则针 3 对第三章提出的问题具体提出完善意见。包括对偿付能力、中介、保险投资 等的监管。　 第五章“国际保险监管的发展趋势及我国监管的适应”，论述了国际保险 监管的发展趋势，并针对我国目前不能采取统一监管的现状，提出了过渡性 的建议。　 总之，在本文中笔者综合运用了系统研究、比较研究的方法，对保险监 管法律制度的基本理论以及我国保险监管的立法和实践问题做了初步的研究 和探讨，以期对我国保险监管的基本理论的研究及法律制度的改革和完善有 所辅益。　  【关键词】：保险监管制度　　体系构建 　 4  监管内容　  监管方式 Abstract Insurance has close relations with economic development and life of  people ,which is a stable machine of  the society .The world pays  attention  to  the  development  of  China’s  insurance  with  high  speed .Under these circumstances ,original insurance supervision legal system can’t accord with the insurance development .The whole legal system of insurance supervision is not perfect ,though the legal system  is developing on a large scale .Because of its  conflicts  ,the  implementation of the system is difficult .There is no systematic legal  systems,  which  can’t  conform  to  the  demands  of  effective  supervision .The article analyses the problems of the insurance supervision ,learning foreign advanced experience ,and puts forward with some specific suggestions on how to perfect the legal system of insurance supervision .
