浅论高校学生管理的法治化-毕业论文.doc

摘 要 随着社会主义法治进程的深入，法治国家要求高等学校走出法治的真空，对高校 来说这是被迫的选择，同时又应是积极主动介入的过程。典型案例表明，学生管理是 高校法治薄弱的突出领域。因此，高校学生管理法治化成为本文的研究对象。 文章分为引言、正文、结论三部分。 引言部分。介绍文章的研究背景、研究现状及体系结构。 第一章提出高校学生管理法治化的基本问题。主要包括以下内容：高校及其法律 地位、高校学生管理的概念及内容、高校学生管理法治化的概念及特征；高校学生管 理法治化的正当性分析，从高校自身主体的法治诉求与法治功效的契合性来展开论 证。 第二章为高校学生管理法治化的理论体系构建。首先分析了现行理论研究的不 足，在此基础上，从目标、内容、结构三个方面构建其理论体系，并分析了四个基本 要素，即权利、权力、制度、价值。 第三章为高校学生管理法治化的实践进路。从立法构建－具体管理－争议处理三 个方面进行分析、提出建议、整合机制，实现高校学生管理法治机制的良性运作。 结论部分。归纳、概括本文的研究目标及所得出的四个结论。 关键词：高校；学生管理；法治 Abstract With the promotion of law governing, the country governed by law requires universities to go out of the vacuum of law governing. This is a choice forced to university, at the same time it should be a course that universities should actively take part in. Typical cases indicate that student administration in university is still a weak field ruled of law. Therefore, the realization of student administration ruled of law in university is chosen to be the target of the research. The article is divided into introduction, body and conclusion three sections. Introduction section introduced the article research backdrop, research present situation and architectural structure.
