论学校监护责任_教育理论论文 论学校监护责任_教育理论论文 摘要:学生在学校期间受到人身伤害或致他人人身伤害，学校是否应当承担责任，应承担何种责任，这个问题一直是近年来困扰教育界和法学界的焦点问题之一，实践中，法院处理此类纠纷对学校责任的认定也不同。笔者认为，学校对此类伤害，既不应承担监护责任，也不应承担保护责任，而应承担教育管理责任。作者从监护制度设立的初衷入手，总结了学生在校期间监护权的问题的争论，即三种不同的观点：学校应承担在校未成年学生的监护责任；学校应承担在校未成年学生的部分监护责任；学校应承担未成年学生的教育保护(管理)责任。并一步对上述三种观点进行剖析，揭示学校在监护人制度中的特殊法律地位，提出了不宜确立学校为监护人。最后文章对学校的教育人地位与义务；学校应承担责任的性质及学校责任的认定进行了全面阐述，以期对解决这一问题有所帮助。 关键词：学校；监护制度；未成年学生；监护责任 Abstract:During the period of school, when students are hurt by human body or making the result of body hurts to the others human, it is one of the focus problems to perplex the educational circles and the legal circles in recent years whether school should or not undertakes the duty. In practice, the court handles this kind of dispute to the school duty too. The writer thinks that the school shouldnt undertake the guardianship duty or to protect the duty, but promise the load the duty to educate and manage to this kind hurt. The thesis commences from the original intention to establish the guardianship system, tallying up the issue of the problem of the guardianship power of students during the period of school, namely three kinds of different standpoints: the school promises a load of the nonage students guardianship duty in the school; the school promises a load of the nonage students part of guardianships duty in the school; the school promises a load of the nonage students education protection and management duty. The thesis proceeds to analysis for above three kinds of standpoints fatherly, announcing the special law position of the public school in guardian system, putting forward that it is improper to establish school as the guardian of the nonage students. Finally the thesis affirms to expatiate completely to education persons position of the school and duty and duties of a load of duties that the school should promise.
