摘 要 村规民约作为一种超越家族规范的社区公共规范,源于乡土社会,符合乡土社会 的生活实际,柔和性地规范着人们的行为，合理地调整着乡土社会的生活秩序。村规 民约是村民自治的重要方式和载体，它适应村民自治的要求从而应运而生,并且在中 国广大农村普遍推行,是村民进行自我管理、自我教育、自我约束的行为规范。它促 进了农村社会有序化，从而有利于乡土社会秩序的形成。降低了政府的治理成本， 为村民进行民主政治参与开辟渠道。是融乡土性与现代民主于一体的的社区公共规 范。 本文从村规民约的起源以及村规民约的基本原理和特征出发，分析了当前村规 民约的现状和面临的困境，阐述了村规民约的功能以及如何规范村规民约的程序， 以说明村规民约存在的合理性和合法性，希望为村民自治的推进和农村法制建设的 发展和完善作一点理论贡献。 通过对村规民约的深入理论分析后本人发现，村规民约是农村社会各阶层在村 务运作中表达自身约束和自我治理的良好渠道，是一种符合现代社会需要的契约性 规范，成为解决当前农村治理难题的一条有效途径。 关健词：村规民约；村民自治；功能；规范 I Abstract As a kind of community public specifications beyond family regulations, Village Regulations and Agreements rise from village society, these regulations and agreements are suitable for the real life of rural areas. Tenderly regulating people’s behavior, reasonably adjusting the life system in village community, Village Regulations and Agreements are the important mode and the carrier of villagers self-government. Village regulations and agreements were born from requirement of villagers self-government, and have been widely implemented in rural areas in China. Also, Village Regulations and Agreements are the standard of conducts which are suitable for villagers to take self-government, self-education and self-regulating. Village regulations and agreements accelerate to regulate the rural society, and are helpful for the forming of the regulations of rural society.
