论因果关系的主观性和层次分类 内容提要 论因果关系的主观性和层次分类 内容提要 目前，学界部分学者认为因果关系具有客观性。但，实践中这种客观性犹如皇帝 的新衣，反而因果关系的主观性特征却很明显。而与这种主观性密不可分的是因果关 系的层次性，即横向层次：内隐因果关系、裁判因果关系、表征因果关系；纵向层次： 损害因果、责任因果；意志层次：心理因果、行为因果。而对主观性和层次性的忽视 导致了学理和实践的脱离以及实践中的繁杂。为此笔者通过因果关系的源流史揭示了 这种主观性的形成、发展过程；通过层次考究或修正当前的因果关系判定方法或提出 新的方法。对上述问题的具体展开就构成了本文之主要内容。 关键词：因果关系；主观性； 层次性 作 者：贾云杰 指导教师：方新军 I Abstract Theory of causation of subjectivity and hierarchical classification Theory of causation of subjectivity and hierarchical classification Abstract At present academic circles some scholars think that causality is objective.
