摘 要 摘 要 财产权作为一项与生命权、自由权并列的三大基本权利之一，已经得到国际 社会的广泛承认，并逐渐为各国法律明文加以保护。搜查、扣押作为刑事侦查中 最常见的法定侦查行为之一，在实现收集犯罪证据、打击犯罪的同时，往往会带 来侵犯公民财产权的负面效应。如何在二者之间求得适当的平衡，已经成为各国 刑事诉讼法所关注的问题。本文从财产权的起源开始分析了财产权保障与刑事搜 查、扣押制度的关系，并在此基础上关注我国现行的搜查、扣押制度在保护公民 财产权方面的不足，而比较法视野下的搜查、扣押制度作为参照系。最后，本文 结合我国国情并借鉴国外有益的原则、制度，提出了从保护公民财产权角度来完 善我国刑事搜查、扣押制度的具体建议。 关键词：搜查，扣押，财产权，司法审查 I Abstract Abstract Property as a right to life, liberty alongside one of the three fundamental rights, has been widely recognized by the international community, and gradually clear national laws to protect them.
