我国环境保护行政协议之法律认知与规制 中文摘要 我国环境保护行政协议之法律认知与规制 中文摘要 生态建设已成为新时期下“五位一体”的重要组成部分，在社会经济发展高速发 展的当下，环境保护事务的重要性日趋提升，然而在现实中环保事务特别是跨流域、 跨区域环境污染的防治仍旧存在着治理机关相互推诿、合作机制缺乏、治理效果不佳 的顽疾，上述现实矛盾倒逼着生态毗连区内的环保行政机关采取了多样性的合作，环 保行政协议就是其中尤为重要的一环。环保行政协议是实践中的创举，对环境污染治 理、环境保护合作事业的发展起到了一定的推动作用，但其仍存在着理论研究匮乏、 法律依据缺少、实践效果不明显等诸多问题。针对上述问题，本文拟从环保行政协议 兴起的社会、理论、法律三个背景出发，从环保行政协议的本体论、实践透析两方面 入手，对环保行政协议做法律层面的认知和分析后提出相关规制和完善建议。 关键词： 行政协议；环境合作治理；实践分析；规制 作 者：车 犇 指导教师：朱 谦 I Abstract Legal Cognition and Regulation of the Administrative Agreement of Environmental Protection Legal Cognition and Regulation of the Administrative Agreement of Environmental Protection Abstract The ecological construction has become an important part of social development goal in new era. The importance of environmental protection affairs is improving during the fast social economic improvement.However ,in practice,there is a number of problems in environmental affairs especially in the environmental pollution prevention and control work across the span of river basins or regions such as management authorities mutual shuffle, lack of cooperation mechanism and little effect .The realistic contradictions forced environmental protection administrative organs in those contiguous zone to take diverse cooperations .The administrative agreement of environmental protection is a innovation in practice, it has played a certain role to the development of the environmental protection cooperation work.But it still exists many problems such as the lack of theoretical resea
