社会保险经办机构法律制度探究.docVIP

　　华　中　科　技　大　学　硕　士　学　位　论　文摘要随着社会的发展和变化，我们正经历着一个人口老龄化加剧，失业率增长，医疗费用居高不下的时代，我们的政府面临着社会风险持续扩张的问题。社会保险是一种人为的制度设计，因此对立法有着天然的依赖，内在地要求必须通过立法建立和实施。在这种社会背景之下，2010年《中华人民共和国社会保险法》终于审议通过，并将于明年施行。在社会保险法中，社会保险经办机构作为社会保险保险人，以主体的身份出现，并有相关的内容对其加以规制，但就目前的情况而言，我国有关社会保险经办机构的法律制度并不完善。本文通过历史研究、比较研究、实证分析研究等方法，对我国社会保险经办机构的有关法律制度进行梳理，总结现有法律制度中存在的问题，并试图找到解决问题的对策。经过研究分析可以发现，我国社会保险法律制度尚处于初创阶段，有关社会保险经办机构的法律制度极为薄弱，相关法律制度的构建必须坚持规范、协调、稳定的原则。社会保险法是权利法，不是行政管理法，应突出社会保险权保障的思想，立法不能偏离这一核心。本文对于完善我国社会保险经办机构法律制度提出了建议。关键词：社会保险经办机构社会保险法法律制度I　　华　中　科　技　大　学　硕　士　学　位　论　文AbstractAsthedevelopmentandthechangeofthesociety,weliveintheageinwhichtheageingofpopulationintensifies,unemploymentrategoupandhighmedicalexpenseshardlyreduce.Thusourgovernmentsarefacingtheproblemofthecontinuousincreaseofthesocialrisk.Socialsecurity,asaman-madesystem,dependsonthelegislationnaturallyandneedstobefoundandcarriedintoexecutionbylawsinherently.Underthissocialbackground,lawofsocialsecurityofthePeople’sRepublicofChinaisadoptedin2010andeffectiveasof2011.Inlawofsocialsecurity,thesocialinsuranceagencie,asinsurerofsocialsecurity,isalegalbodywithcorrelativeprovision.Butatpresent,thelegalsystemofthesocialinsuranceagencieisnotperfect.Thisthesisclearsupthelegalsystemofthesocialinsuranceagencie,summarizetheproblemsoflegalsysteminexistenceandtrytofindthecountermeasuretotheproblemswiththemethodsofhistoricresearch,comparativestudyandpositive.Byanalysisweknowthatourlegalsystemofsocialsecurityisinitsprimarystage,thelegalsystemofthesocialinsuranceagencieissounsubstantial.Wemustpayapersistentefforttoestablishastandardharmoniousstablesystemofsocialinsurancesubject.Socialinsurancelawaimsrathertoprotectrightsbutnottofacilitateadministrativemanagement.Theideologyofsocialinsurancerightssecurityshouldbestressed.Ourlegislatureshouldnotdriftoffthecourseofthiscore.Thisthesiscomesupwiththeadvicetoperfectthelegalsystemofthesocialinsuranceagencie.Keywords:thesocialinsuranceagencielawofsocialsecurityIIlegalsystem独创性声明本人声明所呈交的学位论文是我个人在导师指导下进行的研究工作及取得的研究成果。尽我所知，除文
