Abstract China is one of the most important agricultural countries in the world. Agriculture, farmer and country, so called the Three Rural Issues problem are always the basic problems of social development in our country. the construction of democratic and legal system in rural area is urgent and important. It plays an important role in the new rural area construction. To some degree, it decides the success or failure, gain or loss of the construction of New Countryside ， which is made up of economic construction, political construction, cultural construction, social construction, and ecological civilization construction. The Central Committee of the CCP’s suggestion on the 11th five year plan about national economy and social development point it out clearly that the construction of New Countryside should obey a guiding principle that is developed production, well-off life, civilization atmosphere, clean village and democratic management. The 12th five-year Plan about national economy and social development and some other documents gave more specific guidance on this issue. To follow this trend, the construction of democracy and legal system in new rural area construction is put on the government agenda. Since the Reform and Opening up of China, especially in recent years, the study on new rural construction flourished.
