I 摘 要 在我国法制现代化的进程中，律师职业伦理关系及其职业道德问题成为社会 公共生活中的重要话题之一。大多数公众打官司，说到底是通过与律师打交道， 借助律师的帮助来表达自己的权利意愿。因此，律师在从业时，职业道德问题就 与其法律技能水平一样显得十分重要，甚至在某种程度上说比法律技能水平更为 重要。由于律师角色的复杂性，律师与法律、律师与委托人、律师与公众、律师 与司法权力机关之间存在诸多伦理问题。 在律师与法律的关系方面，正义与胜诉是律师追求的重要价值，当两者出现 不一致的时候，律师应当坚持维护正义和法律的正确实施。因为以平等为目标的 正义是人类不懈地追求，也是法律的核心价值。律师作为法律职业者，应当是正 义的维护者。 在律师与委托人的关系方面，一般而言，律师与委托人是种双向选择的关系， 但是，律师一旦接受代理，基于职业要求，便不能轻易辞去代理。此时，当委托 人提出不合理甚至不合法的要求时，律师必须拒绝相关要求，必要时辞去代理。 此外，律师在代理案件的过程中，必须尊重当事人的自主权，不能替当事人做出 决定，应当始终坚持忠实于委托人与尽职尽责代理的职业要求。 在律师与公众的关系方面，律师的职业道德与公众的共同道德之间既有相统 一的时候，又有不一致的时候，当二者相冲突的时候，律师必须在共同道德所能 接受的底线范围内遵守职业道德的要求。 在律师与司法权力机关的关系方面，由于我国传统文化的影响，人们无法对 律师职业形成正确认识，加之我国法制仍有待完善的缘故，作为私权代表的律师， 在与司法公权相处的过程中，常常受到排挤；同时，由于我国部分律师自身道德 修养不高，出现不能尽职代理，却热衷拉拢关系、贿赂法官等不良行为。所以， 需要从制度上，明确律师性质，促进法律职业共同体的形成；思想上，加强法学 院学生职业道德培养；个人修养上，重视律师勇敢和节制美德的塑造，从而逐步 建立起与司法权力机关互相制约的良性关系。 关键词：律师 职业道德 正义 责任 勇敢 II Abstract In the process of the legal system modernization in China, the lawyer ethics relation and professional ethics problems become one of the important topics in social public life. In many cases, most public going to law are through dealing with lawyers to gain the help to express their rights will. Therefore, when the lawyers are working, the professional ethics are as important as legal skills. We can even say professional ethics are more important than legal skills. Because of the complexity of the role of lawyer, the relation between lawyers and justice, lawyers and clients, lawyers and the public,lawyers andthepowerofjudicialorgan areexistmanyproblems. Therelationshipbetween Lawyersand law:Justiceandsuccessareimportant valuetolawyers.Whentheyagainst each other,alawyershouldadheretomaintain justiceandUpholdingthelawcorrectlyimplement,becausetheaimofequaljusticeis thecorevalueofthelaw.
